1. what you get
When you buy a Bearish NFT, you get two things: the NFT itself (yours to hold, sell, or transfer) and a license to use the art. This license lets you use your bear for personal and limited commercial purposes.
You don't own the underlying intellectual property—Bearish does. But you do get real rights to use your specific bear's artwork within the terms below.
2. personal use
You can use your bear's art for any personal, non-commercial purpose:
- Profile pictures on social media
- Printing for your own enjoyment (posters, stickers, etc.)
- Sharing online to flex your bear
- Personal websites or portfolios
3. commercial use
You can make money with your bear's art, up to $500,000 in gross revenue per year. This includes:
- Merchandise (t-shirts, mugs, prints)
- Digital content (videos, streams, podcasts)
- Apps or games featuring your bear
- Physical products
If you're making more than $500K/year from your bear, reach out to us for an extended commercial license.
4. what's not allowed
Some things are off-limits:
- Minting new NFTs using your bear's art
- Using your bear with hate speech, violence, or illegal content
- Implying official Bearish endorsement or partnership
- Using Bearish branding, logos, or trademarks (see below)
- Selling the license separately from the NFT
5. trademarks
The Bearish name, logo, and brand identity belong to us. You can't use them in ways that suggest we endorse or sponsor your products.
You can make factual references like "featuring art from a Bearish NFT" or "powered by a Bearish bear." Just don't slap our logo on your merch or use "Bearish" as part of your product name.
6. derivative works
You can create derivative works based on your bear—remixes, mashups, new compositions. The same rules apply: personal use is fine, commercial use is capped at $500K/year, and you can't mint new NFTs.
If you create something derivative, make it clear it's not an official Bearish product. A simple "unofficial" or "fan-made" disclaimer works.
7. sublicensing
You can grant limited rights to others who help you create products—manufacturers, developers, designers. But they must agree to the same restrictions in this license.
You can't sell or transfer the license on its own. It only moves when the NFT moves.
8. selling your nft
When you sell or transfer your Bearish NFT, the license automatically transfers to the new owner. You lose all rights to use the art the moment it leaves your wallet.
Make sure to stop using the art in any products or content once you sell. The new owner gets the rights, not you.
9. termination
If you break these terms, your license ends. We'll give you 10 days to fix the issue after we notify you. If you don't fix it, the license terminates and you must stop all use of the art.
Selling or transferring the NFT also ends your license—but that's expected, since the new owner gets the rights.
